Role Of Judiciary In India

The Judiciary of India is an independent body that safeguards the rights of citizens to maintain peace and harmony among people. Hence, the role of the judiciary becomes very important and fundamental. The Judiciary is the mechanism of resolution of disputes. According to the doctrine of separation of power, the judiciary is neither responsible to make statutory laws nor enforce laws rather its interprets, defend and apply the valid law by facts and cases. Every country has a different judiciary system to be followed just like India follows the common law system.

The judiciary has been divided into three forms - advisor jurisdiction, appellate jurisdiction, and original jurisdiction. The advisory jurisdiction works under Article 143(6) where the supreme court advises the president of India on matters relating to public importance. The appellate jurisdiction works under Articles 132(2), 133(3), 134(4) in respect of judgment, order, or decree given by the high court on matters of civil or criminal cases. The original jurisdiction works under Article 131 that governs the matter between the government and one or more states. Along with this, the Indian judiciary has the power of writ jurisdiction to protect the fundamental rights of citizens enforced by the supreme and the high court. Therefore, the judiciary of India is the delivery mechanism to justice.

In the 21st century, the Indian judiciary has expanded its hands and is working on speedy delivery to justice with a free and fair system. By safeguarding, every right of the citizen judiciary is the guardian of the Indian constitution.
